State Ruling May Delay Federal Lethal Injection Case

    In the continuing battle over capital punishment in California, a state court ruling threatens to further delay lethal injection here for more than an year.  Marin County Superior Court Judge ruled that the Calif. Department of Corrections and Rehabilitation failed to follow correct procedure when it chose to use the three-drug lethal injection to execute inmates.  In her decision, the judge criticized the state for failing to offer for consideration the one-drug method alternative.  Unless there is an appeal, the decision forces the agency to restart the process of deciding what drug concoction to use for executions.
