Questioning in the patrol car does not violate the constitutional right

The defendant agreed to be interviewed in the patrol car because his trailer was cold and dark and also made statements en route to the police station.   The court found that the defendant was not in custody until he was formally arrested and given his Miranda advisements, so the statements were not suppressed as evidence against him.

Whether a defendant is in custody for Miranda purposes is a mixed question of law and fact.   Allow the Law Offices of Arna H.
