DNA Sample From Butt Thown To Sidewalk Did Not Violate Privacy

   DNA of a suspect in a murder was discovered from a crime scene.  The police obtained a sample of the defendant's DNA by following him and then collecting a cigarette butt he had discarded on a public sidewalk.  The defendant's DNA matched the DNA from the crime scene.  The State Supreme Court found this was not a violation of the defendant's privacy because it was considered abandoned, just like discarded trash, the defendant had no expectation of privacy concerning the testing of it to identify him as a suspect in a criminal investigation.
